NEW YORK CITY NECK INJURY ATTORNEY

NEW YORK CITY NECK INJURY ATTORNEY

Neck injuries are one of the most common injuries from traffic accidents, and the symptoms are not always present right away.  That’s why you need an experienced New York City neck injury attorney to represent you.  After a car, bus, truck, or bicycle accident, it’s a good idea to check to see if your neck has a full range of motion. Gently moved your down and around in a circle and notice if there is any pain with this movement.  Our necks are less protected than other parts of the body, and what might feel like a slight twinge initially could be a herniated disc, a torn ligament or even a slight fracture. This is all the more reason you should seriously consider taking an ambulance to the hospital directly from the scene of an accident.

It’s also a good idea to call an expert New York City Neck Injury Attorney to find out what you might need to do right away to preserve your rights.  At Wittenstein & Wittenstein, we’ve been holding client’s hands through their cases for over 60 years. Let us work on the legal aspects of your situation, while you focus on returning to full health.  Please call us for a free consultation at 718-261-8114.

Strains and Sprains (Whiplash)

Whiplash is the lay term for mild traumatic injuries to the neck.  Sensitive tendons, muscles, and ligaments work together in your neck.   A strain of the neck is when the muscle or tendon is suddenly contracted or stretched.  A sprain is when the ligaments are stretched or torn. It is very difficult to diagnose a neck problem with any certainty without Magnetic Resonance Imaging (MRI) films.  With an MRI, a doctor can determine the extent of your neck problem and recommend the best treatment.

Herniated Disc

The neck (cervical spine) is made up of discs with a hard shell and a soft gel filled interior.  This works to absorb force and protects the spine. When the gel inside the disc protrudes, due to trauma or degeneration, this is known as a herniated disc.  Symptoms include a shooting pain that radiates down the arms, numbness or tingling and muscle weakness.

A herniated disc is usually diagnosed with an MRI and clinical testing of reflexes, range of motion and pain level.  Treatment is usually a combination of physical therapy, chiropractic treatment, pain relievers and muscle relaxants. Rarely, surgery is necessary to relieve the pain.

These are the most common types of traumatic neck injuries from traffic accidents.  If you have sustained an injury to your neck, you should seek medical treatment and consider suing the negligent party for compensation.  Please call Wittenstein & Wittenstein for a free consultation at 718-261-8114

Art Movements, Protest Lineage, and Why This Work Exists

Political art has never been ornamental. At its best, it has functioned as logistics, memory, and coordination — a parallel system of communication when official systems fail or turn hostile. From the hand-printed posters of the U.S. Civil Rights era, to anti-apartheid graphics in South Africa, to the silk-screened iconography of May ’68 in Paris, visual language has repeatedly done three things movements require:signal alignment, create cohesion, and make resistance visible at scale. In the 1950s and 1960s, civil rights organizers did not treat posters, buttons, and printed materials as accessories. They were how people recognized one another. How messages traveled when mass media refused to carry them. How collective identity took shape across neighborhoods [...]

The Importance of Personal Service

There are a plethora of billboards from attorneys promising that they are the biggest firm in town. This reminds of me the sign next to the golden arches that announces that billions of people have been served. Does this mean that they make the best burgers? No, it just means that they are providing service to many people and that’s not possible unless what they are offering is pretty watered down product. I like my burgers thick, rare, hot off the grill and eaten on a real plate - something that’s not possible to mass produce. When you’re seeking a lawyer, you’re looking for somebody that can bring your case to life, not a fleeting association [...]

What Is Negligence?

You’ve probably heard people say that you can sue for negligence when you’ve been injured, but you might not know exactly what the word means. The definition of negligence is simply “failing to use proper care.” This can mean something very different depending on what the activity is, and whether training or a license is required. Just because you were hurt, doesn’t mean that you will be successful suing the responsible parties. That’s why it’s important to speak to a negligence lawyer in Queens to find out if what happened to you is something that justifies a lawsuit. I Signed a Liability Waiver, Can I Still Sue?

Most Liability Waivers are Not Enforceable in New York Companies are increasingly requiring waivers for participating in many events and recreational activities.  They are intended to protect businesses from lawsuits, and act as psychological deterrents as people often assume that they cannot sue for their injuries because they signed a waiver.  If you’ve been seriously injured, an experienced New York personal injury lawyer might be able to help you make a claim, even though you signed a waiver! In fact, New York law generally holds waivers of liability for negligence unenforceable.  So if you are wondering, "I signed a liability waiver, can I still sue,?" the answer, mostly likely, is yes! What is a Liability Waiver? [...]

Queens Is the New Brooklyn

Brooklyn used to be where artists went because it was cheap, flexible, and unpoliced. That version of Brooklyn is gone. What’s left is a real-estate brand with a cultural afterimage—galleries designed around sales, neighborhoods shaped by marketing decks, and an art scene that feels increasingly managed. Queens is where the work actually happens now. You can see it across the borough—in Ridgewood, Sunnyside, Forest Hills, Astoria, and Long Island City—not because there’s a single “scene,” but because artists here are still allowed to work without being pushed into a look, a market, or a lane. Queens hasn’t flattened itself into a style. It doesn’t need to. That range showed up clearly at the Queens Says [...]

How Policy Limits Impact Accident Claims

You’d be hard-pressed to drive anywhere in town without encountering billboards with Queens car attorneys, and other personal injury lawyers in NYC, boasting about their multi-million-dollar settlements and verdicts. This advertising is intended to not only give people the impression that you can get big money for minor injuries but also that having a big injury means you’ll collect astronomical sums. This couldn’t be farther from the truth. The harsh reality is that even if you sustain injuries, you’re almost always limited to collecting the full policy limits of the applicable insurance. New York Insurance Law In New York state you are required to carry a minimum of $25,000/$50,000 of liability insurance in order to register [...]

Dangers of the State Island Ferry

Ferry travel feels so safe, none of the lane changing and stress of driving, but The New York Post has reported that ferry captains warn that The Staten Island Ferries are “ticking time bombs.”  After a major accident in 2003, there has been some scrutiny of the safety of these aging ferries, and what’s been revealed shows that most of the ships suffer from serious safety problems.  The ferry captain, who wanted to remain anonymous said of the ship’s propellers, “They often fail, resulting in the shutdown of one or more of the four “drives” that are linked to propellers, making it at times impossible to slow, or even stop, the boat.”  [...]

For Goodness Sake – Don’t Leave Your Car in Storage!

If you have collision insurance (aka full coverage) for your car, your insurance company will inspect your car and pay you promptly for the damage.  If you don't have this coverage, you can make a claim against the car that caused the accident to collect money to fix your car (or the book value of your car if it is "totaled.") This can sometimes happen quickly as well.  If you are hit in the rear by somebody that insured with, let's say, GEICO, they will come and inspect your car and pay you for the damages or book value.  This will seem not much different than if you had full coverage (and there's no deductible.)  That's [...]
