NECK INJURIES

NEW YORK CITY NECK INJURY ATTORNEY

NEW YORK CITY NECK INJURY ATTORNEY

Neck injuries are one of the most common injuries from traffic accidents, and the symptoms are not always present right away.  That’s why you need an experienced New York City neck injury attorney to represent you.  After a car, bus, truck, or bicycle accident, it’s a good idea to check to see if your neck has a full range of motion. Gently moved your down and around in a circle and notice if there is any pain with this movement.  Our necks are less protected than other parts of the body, and what might feel like a slight twinge initially could be a herniated disc, a torn ligament or even a slight fracture. This is all the more reason you should seriously consider taking an ambulance to the hospital directly from the scene of an accident.

It’s also a good idea to call an expert New York City Neck Injury Attorney to find out what you might need to do right away to preserve your rights.  At Wittenstein & Wittenstein, we’ve been holding client’s hands through their cases for over 60 years. Let us work on the legal aspects of your situation, while you focus on returning to full health.  Please call us for a free consultation at 718-261-8114.

Strains and Sprains (Whiplash)

Whiplash is the lay term for mild traumatic injuries to the neck.  Sensitive tendons, muscles, and ligaments work together in your neck.   A strain of the neck is when the muscle or tendon is suddenly contracted or stretched.  A sprain is when the ligaments are stretched or torn. It is very difficult to diagnose a neck problem with any certainty without Magnetic Resonance Imaging (MRI) films.  With an MRI, a doctor can determine the extent of your neck problem and recommend the best treatment.

Herniated Disc

The neck (cervical spine) is made up of discs with a hard shell and a soft gel filled interior.  This works to absorb force and protects the spine. When the gel inside the disc protrudes, due to trauma or degeneration, this is known as a herniated disc.  Symptoms include a shooting pain that radiates down the arms, numbness or tingling and muscle weakness.

A herniated disc is usually diagnosed with an MRI and clinical testing of reflexes, range of motion and pain level.  Treatment is usually a combination of physical therapy, chiropractic treatment, pain relievers and muscle relaxants. Rarely, surgery is necessary to relieve the pain.

These are the most common types of traumatic neck injuries from traffic accidents.  If you have sustained an injury to your neck, you should seek medical treatment and consider suing the negligent party for compensation.  Please call Wittenstein & Wittenstein for a free consultation at 718-261-8114

Queens, Brooklyn, and the Geography of Resistance Art

Art movements are shaped by geography — not just aesthetics. For decades, Brooklyn functioned as New York’s shorthand for experimental political art. That reputation was earned. Poster workshops, print collectives, underground presses, and radical galleries played a real role in anti-war organizing, labor movements, and later global justice actions. But movements migrate. Queens is where political art now intersects most directly with lived conditions. It is where organizers, immigrants, students, workers, and artists share space without insulation. The art is less polished, less ironic, and more accountable to consequence. That shift mirrors global patterns. In cities worldwide, the most effective protest art emerges not from cultural centers, but from pressure points — places where policy [...]

President George Bush’s Legacy- 7 Ways How the ADA Impacts Us Today

President George Bush’s Legacy- 7 Ways How the ADA Impacts Us Today A little over a week ago, on November 30, 2018, we lost our 41st president. George H.W Bush served as president from 1989-1993, and prior to his presidency, served as vice president from 1981 to 1989. Though we may not agree with all of his policies, the American Disability Act passed during his administration continues to be a major contribution to our society. The American Disability Act (ADA) was signed into law on July 26, 1990 and was implemented with the goal of increasing inclusion for persons with disabilities in employment,  telecommunications, public accommodations in both the public and private sector. Most of us, [...]

EXECUTIVE–WORKER PAY ALIGNMENT ACT

SUMMARY Executive–Worker Pay Alignment Act The Executive–Worker Pay Alignment Act aligns increases in executive compensation with wage growth for workers at large employers. When a company increases total compensation for its highly paid executives, worker wages must increase by the same percentage during the same fiscal year. If executive compensation does not increase, the Act does not apply. The Act does not set wages, mandate bonuses, or cap executive pay outright. It targets a specific driver of wage disparity: raising executive pay while leaving workers out. Executive compensation is treated as a connected system, preventing evasion through re-labeling, new executive hires at higher rates, equity restructuring, or compensation paid through affiliates. Injured Construction Workers Have Rights Under Labor Laws

Labor Laws protect construction workers injured on the job.  New York’s Labor Laws impose a heavy duty on employers to provide a “safe place to work.”  There is special protection for Construction Workers injured while doing work such as renovation, demolition, alteration or repair of buildings and other structures.  The justification for these laws is that construction work is an extremely dangerous profession, and employers should be discouraged from “cutting corners” on safety with these strict laws.  Injured construction workers have protection under these laws that allow them to sue their employers in addition to collecting Workers Compensation benefits. Section 200 This is the “safe place to work” law, and it very broad.  In order to bring [...]

Vaccination Laws Upheld Despite Religious Objections

In the United States, the First Amendment of the Constitution protects our right to practice the religion of our choice.  The State and City of New York have passed laws that offer increased protection from interference with religious practice and discrimination based on religion.  Just like the right to move your fist ends at the tip of another person’s nose, the government will limit the right to a religious practice that they believe endangers the community as a whole.  Justice Denise Hartman upheld the law abolishing religious exemptions to vaccinations, referring to a US Supreme Court decision from 1944, “The right to practice religion does not include liberty to expose the community or the child to [...]
