NEW YORK CITY NECK INJURY ATTORNEY

NEW YORK CITY NECK INJURY ATTORNEY

Neck injuries are one of the most common injuries from traffic accidents, and the symptoms are not always present right away.  That’s why you need an experienced New York City neck injury attorney to represent you.  After a car, bus, truck, or bicycle accident, it’s a good idea to check to see if your neck has a full range of motion. Gently moved your down and around in a circle and notice if there is any pain with this movement.  Our necks are less protected than other parts of the body, and what might feel like a slight twinge initially could be a herniated disc, a torn ligament or even a slight fracture. This is all the more reason you should seriously consider taking an ambulance to the hospital directly from the scene of an accident.

It’s also a good idea to call an expert New York City Neck Injury Attorney to find out what you might need to do right away to preserve your rights.  At Wittenstein & Wittenstein, we’ve been holding client’s hands through their cases for over 60 years. Let us work on the legal aspects of your situation, while you focus on returning to full health.  Please call us for a free consultation at 718-261-8114.

Strains and Sprains (Whiplash)

Whiplash is the lay term for mild traumatic injuries to the neck.  Sensitive tendons, muscles, and ligaments work together in your neck.   A strain of the neck is when the muscle or tendon is suddenly contracted or stretched.  A sprain is when the ligaments are stretched or torn. It is very difficult to diagnose a neck problem with any certainty without Magnetic Resonance Imaging (MRI) films.  With an MRI, a doctor can determine the extent of your neck problem and recommend the best treatment.

Herniated Disc

The neck (cervical spine) is made up of discs with a hard shell and a soft gel filled interior.  This works to absorb force and protects the spine. When the gel inside the disc protrudes, due to trauma or degeneration, this is known as a herniated disc.  Symptoms include a shooting pain that radiates down the arms, numbness or tingling and muscle weakness.

A herniated disc is usually diagnosed with an MRI and clinical testing of reflexes, range of motion and pain level.  Treatment is usually a combination of physical therapy, chiropractic treatment, pain relievers and muscle relaxants. Rarely, surgery is necessary to relieve the pain.

These are the most common types of traumatic neck injuries from traffic accidents.  If you have sustained an injury to your neck, you should seek medical treatment and consider suing the negligent party for compensation.  Please call Wittenstein & Wittenstein for a free consultation at 718-261-8114

Betaville: Capitalist Dystopia

Most dystopias warn us about authoritarian governments, surveillance states, or collectivist control. Betaville does something far more disruptive: it imagines a world ruled by capitalism, fashion, and the aesthetics of power. In this universe, falling out of style is not a social misstep — it’s a threat to your safety, your identity, even your standing as a person. That’s what makes Betaville such a rare dystopia. Instead of government tyranny, the oppressor is trend culture weaponized. Fashion dictates law. Aesthetic taste ranks higher than ethics. And value, both personal and social, is determined by image. This is capitalism at its most absurd and its most dangerous — a system where the marketplace decides who deserves [...]

Types of Damages Recoverable in Personal Injury Law

Generally, a personal injury case begins with establishing negligence, which is the recognition of a legal duty and breach of that legal duty.  This means that there must be something expected, such as a property owner’s duty to keep the premises safe, and the “breach” might be oil left spilled on the floor for an unreasonable amount of time.  It also needs to be proven that the “breach of duty” caused the injury claimed.  This is known as “causation.”  Just because the oil was on the ground, doesn’t mean it caused the accident, it must be proven that that it was slipping on the oil that caused the accident. Once negligence is proven, as above, the [...]

What’s a Negligence Lawyer?

Lawyers graduate with a degree called a Juris Doctor that is required in New York, and in most other states, as a prerequisite for taking the bar examination and admission to the profession. Whereas doctors usually specialize in a particular area and become certified to practice medicine in that field, lawyers all graduate as generalists after studying many areas of the law in school. One of the major areas of law school study, called “torts” is about civil liability for injurious conduct. A negligence lawyer is an attorney that specializes in collecting money for people that have been injured by the negligent, reckless or intentional acts of others. Wittenstein & Wittenstein is the negligence lawyer in [...]

With Donald Trump and his oligarchs back in power, we are sure to see a reduction in federal rights, including the right to collect compensation from negligent parties for injuries caused by negligence, recklessness, and intentional conduct. Is Your Right to Vote Disappearing?

Is Your Right to Vote Disappearing? wittenstein.com  has been a little over 50 years since President Lyndon B. Johnson signed the Voting Right Act of 1965 into law.  Passed during the Civil Rights era, it sought to remove barriers meant to keep African Americans from voting on election day. These barriers included literacy tests, poll taxes, and intimidation by law enforcement officials.  By the end of 1965 a quarter million more African Americans were registered to vote.
