NECK INJURIES

NEW YORK CITY NECK INJURY ATTORNEY

NEW YORK CITY NECK INJURY ATTORNEY

Neck injuries are one of the most common injuries from traffic accidents, and the symptoms are not always present right away.  That’s why you need an experienced New York City neck injury attorney to represent you.  After a car, bus, truck, or bicycle accident, it’s a good idea to check to see if your neck has a full range of motion. Gently moved your down and around in a circle and notice if there is any pain with this movement.  Our necks are less protected than other parts of the body, and what might feel like a slight twinge initially could be a herniated disc, a torn ligament or even a slight fracture. This is all the more reason you should seriously consider taking an ambulance to the hospital directly from the scene of an accident.

It’s also a good idea to call an expert New York City Neck Injury Attorney to find out what you might need to do right away to preserve your rights.  At Wittenstein & Wittenstein, we’ve been holding client’s hands through their cases for over 60 years. Let us work on the legal aspects of your situation, while you focus on returning to full health.  Please call us for a free consultation at 718-261-8114.

Strains and Sprains (Whiplash)

Whiplash is the lay term for mild traumatic injuries to the neck.  Sensitive tendons, muscles, and ligaments work together in your neck.   A strain of the neck is when the muscle or tendon is suddenly contracted or stretched.  A sprain is when the ligaments are stretched or torn. It is very difficult to diagnose a neck problem with any certainty without Magnetic Resonance Imaging (MRI) films.  With an MRI, a doctor can determine the extent of your neck problem and recommend the best treatment.

Herniated Disc

The neck (cervical spine) is made up of discs with a hard shell and a soft gel filled interior.  This works to absorb force and protects the spine. When the gel inside the disc protrudes, due to trauma or degeneration, this is known as a herniated disc.  Symptoms include a shooting pain that radiates down the arms, numbness or tingling and muscle weakness.

A herniated disc is usually diagnosed with an MRI and clinical testing of reflexes, range of motion and pain level.  Treatment is usually a combination of physical therapy, chiropractic treatment, pain relievers and muscle relaxants. Rarely, surgery is necessary to relieve the pain.

These are the most common types of traumatic neck injuries from traffic accidents.  If you have sustained an injury to your neck, you should seek medical treatment and consider suing the negligent party for compensation.  Please call Wittenstein & Wittenstein for a free consultation at 718-261-8114

Honest Personal Injury Attorney – Is this an Oxymoron?

I tend to be the kind of person that expects the best from others, but lately, so many of my clients have been telling me horror stories about their experiences with other Personal Injury Attorneys. True, Personal Injury Attorneys and especially Car Accident Attorneys do not have the best reputation for honesty. My father trained me thirty years ago to be honest and treat all the clients with the utmost respect. I find it shocking how few attorneys actually do this. That's what prompted me to write this blog post, "Honest Personal Injury Attorney - is this an Oxymoron?" Are we like jumbo shrimp? Are so few of aware of the ethical rules and willing to [...]

What Damages can be Recovered for Personal Injury Claims?

Most people know that they can collect money for “pain and suffering” from parties that accidentally or intentionally harm them, but wonder if there are other types of compensation that can be collected.  This will help you get the big picture about the structure of personal injury claims, so that when you consult with your Brooklyn car accident attorney or NYC Construction accident attorney, you will be able to ask great questions. Future Medical Costs For most car accidents, first-party “no-fault” benefits will cover $50,000 in medical bills, lost earnings and out-of-pocket expenses.  This fund will usually be sufficient to cover current medical costs, but some types of injuries can cause problems much later in life.   [...]

SUMMARY January 20, 2029 President Orders Enforcement and Recovery of Unlawful Self-Enrichment from Public Office Today, the President signed an Executive Order directing the identification, disclosure, and recovery of profits derived from the misuse of public office for personal enrichment. The Order instructs federal agencies to enforce existing ethics, forfeiture, and unjust enrichment laws to recover improperly obtained funds for the public treasury. It clarifies ethical obligations long recognized in law and tradition, and restores the principle that public office [...]

Understanding New York’s No-Fault Law

New York is one of the twelve states in the country with no-fault motor vehicle accident laws. The other no-fault states are Florida, Kansas, Hawaii, Massachusetts, Kentucky, Minnesota, Michigan, New Jersey, North Dakota, Utah and Pennsylvania. It’s called no-fault because your medical bills, lost wages and some out of pocket expenses are paid regardless of how the accident happened. What many people don’t know is that the law was passed to decrease personal injury claims, so it limits lawsuits against the at fault parties to cases where there is a “serious permanent injury.” This law is complicated and failing to properly meet the requirements can cause your case to be delayed or even dismissed. That’s why [...]

Catastrophic Injuries Require A Prompt Legal Response

Call Wittenstein & Wittenstein at 718-261-8114 for a free consultation. You don’t have to pay until we win. President George Bush’s Legacy- 7 Ways How the ADA Impacts Us Today

President George Bush’s Legacy- 7 Ways How the ADA Impacts Us Today A little over a week ago, on November 30, 2018, we lost our 41st president. George H.W Bush served as president from 1989-1993, and prior to his presidency, served as vice president from 1981 to 1989. Though we may not agree with all of his policies, the American Disability Act passed during his administration continues to be a major contribution to our society. The American Disability Act (ADA) was signed into law on July 26, 1990 and was implemented with the goal of increasing inclusion for persons with disabilities in employment,  telecommunications, public accommodations in both the public and private sector. Most of us, [...]

What Types Of Accidents Cause The Most Serious Injuries?

Any type of traumatic injury calls for evaluation to determine its severity, but the lion’s share of injuries from car accidents and falls are relatively minor. Accidents involving heavy impacts and falls from a significant height cause the majority of catastrophic disabilities such as paralysis, loss of a limb, blindness and loss of cognition. In order to collect the huge amount of compensation they’ll need to regain as much quality of life as possible, victims need experienced and specialized legal representation. For example, workers injured on a construction site should hire a NYC construction accident lawyer and people injured by large vehicles should retain a truck accident lawyer in NYC. How To Choose The Best NYC [...]

What is a Personal Injury Lawyer?

There are two basic types of attorneys - criminal and civil. Criminal attorneys prosecute and defend clients for criminal cases. There are many types of civil law including matrimonial, commercial, will and estates and personal injury law. Personal injury law encompasses a wide range of matters that are pursued by injured plaintiffs against defendants that have caused them harm. The lion’s share of personal injury lawyers in NYC handle car accidents, slip and fall, animal attacks and other common types of accident cases, but some negligence lawyers in Queens also handle more sophisticated claims. If you’ve been seriously injured by somebody else’s negligence, recklessness or intentional act, it’s always worthwhile to speak to a personal injury [...]
