NEW YORK CITY NECK INJURY ATTORNEY

Neck injuries are one of the most common injuries from traffic accidents, and the symptoms are not always present right away.  That’s why you need an experienced New York City neck injury attorney to represent you.  After a car, bus, truck, or bicycle accident, it’s a good idea to check to see if your neck has a full range of motion. Gently moved your down and around in a circle and notice if there is any pain with this movement.  Our necks are less protected than other parts of the body, and what might feel like a slight twinge initially could be a herniated disc, a torn ligament or even a slight fracture. This is all the more reason you should seriously consider taking an ambulance to the hospital directly from the scene of an accident.

It’s also a good idea to call an expert New York City Neck Injury Attorney to find out what you might need to do right away to preserve your rights.  At Wittenstein & Wittenstein, we’ve been holding client’s hands through their cases for over 60 years. Let us work on the legal aspects of your situation, while you focus on returning to full health.  Please call us for a free consultation at 718-261-8114.

Strains and Sprains (Whiplash)

Whiplash is the lay term for mild traumatic injuries to the neck.  Sensitive tendons, muscles, and ligaments work together in your neck.   A strain of the neck is when the muscle or tendon is suddenly contracted or stretched.  A sprain is when the ligaments are stretched or torn. It is very difficult to diagnose a neck problem with any certainty without Magnetic Resonance Imaging (MRI) films.  With an MRI, a doctor can determine the extent of your neck problem and recommend the best treatment.

Herniated Disc

The neck (cervical spine) is made up of discs with a hard shell and a soft gel filled interior.  This works to absorb force and protects the spine. When the gel inside the disc protrudes, due to trauma or degeneration, this is known as a herniated disc.  Symptoms include a shooting pain that radiates down the arms, numbness or tingling and muscle weakness.

A herniated disc is usually diagnosed with an MRI and clinical testing of reflexes, range of motion and pain level.  Treatment is usually a combination of physical therapy, chiropractic treatment, pain relievers and muscle relaxants. Rarely, surgery is necessary to relieve the pain.

These are the most common types of traumatic neck injuries from traffic accidents.  If you have sustained an injury to your neck, you should seek medical treatment and consider suing the negligent party for compensation.  Please call Wittenstein & Wittenstein for a free consultation at 718-261-8114

Can I Sue For Sexual Abuse When I Was A Child?

The answer is yes. The Child Victims Act, passed in 2019, changed the law so that victims of sexual abuse, that are under the age of 55, can sue persons and organizations for child sexual abuse, no matter how long ago it occurred. For example, you could sue a coach that mistreated you at your elementary school in 1970 or a pediatrician that fondled you in 1975. Since the law was enacted, many victims have collected compensation for the abuse they suffered. It’s difficult for victims to tell their story, so the patient kind ear of a woman child injury attorney makes it easier to come forward with your story. Claims must be filed by August, [...]

President George Bush’s Legacy- 7 Ways How the ADA Impacts Us Today

President George Bush’s Legacy- 7 Ways How the ADA Impacts Us Today A little over a week ago, on November 30, 2018, we lost our 41st president. George H.W Bush served as president from 1989-1993, and prior to his presidency, served as vice president from 1981 to 1989. Though we may not agree with all of his policies, the American Disability Act passed during his administration continues to be a major contribution to our society. The American Disability Act (ADA) was signed into law on July 26, 1990 and was implemented with the goal of increasing inclusion for persons with disabilities in employment,  telecommunications, public accommodations in both the public and private sector. Most of us, [...]

Trump Guts Worker Safety

According to the AFL-CIO, Trump’s is obliterating worker safety regulations, resulting in an increasing number of worker deaths and injuries, especially in dangerous occupations such as construction. Construction accidents which maim and kill workers increase and protections for their health and safety are abolished.  Due to these changes construction worker safety is at a 21st Century low, with accidents on the rise.  Here are some examples of changes in laws and regulations: Repealed an Occupational Safety and Health Administration rule requiring employers to keep accurate injury records (PL-115-21).  Clearly, maintaining records of injuries is important so that employers that have more injuries can be investigated as to their safety practices, fined and forced to maintain [...]

Reject the Evidence of Your Eyes and Ears: Orwell’s 1984, Trump, ICE, and the Loyalty Test of Fascism

George Orwell’s 1984 warned that authoritarian power ultimately demands one thing above all else: loyalty proven by denying reality itself. That warning is no longer abstract. From January 6 to the killing of Nicole Good by ICE, Americans are being asked to reject what they can plainly see and hear—and to treat that denial as a civic duty. “The party told you to reject the evidence of your eyes and ears. It was their final, most essential command.”—George Orwell, 1984 The second sentence is the point. Orwell was not describing secret propaganda or subtle mind control. He was describing a system in which truth becomes subordinate to loyalty. Once people can be trained to say [...]

When you’ve injured in a car accident – don’t refuse the ambulance!

The other day a client called, telling me that she was very nervous about what to do because she just had a car accident. She said that she had the green light, but the woman that blasted through a red light, lied to the police, and the police report says that the accident is a "question of lights." She said she had a witness, a pedestrian, that had to jump out of the way as that woman sped through a red light. She said she was hurt and so was her mother. I told her she should come in right away. She said she was busy and could not come in until next Tuesday. By the [...]

What Are High Crimes and Misdemeanors

High crimes and misdemeanors is the Constitutional standard the Congress must use to decide whether or not to impeach and remove a sitting President. It’s always been difficult to understand Constitutional law because it’s written in old-fashioned language and is often intentionally vague. That’s why my teaching assistant review sessions, for the late great civil rights lawyer Haywood Burns, attracted hundreds of students and packed the auditorium at CUNY Law School. It was hard enough to understand these concepts back in the 1990’s, but now we live in the age of “fake news” and it’s becoming increasingly difficult to know who to believe. The discussions we see on TV and read in the paper are usually [...]
