PROVIDING “NOTICE”

Many slip and fall cases are minimized because the owner did not have “notice” of the condition.  If you notice hazards where you live or work, its good practice to report this in writing to the person responsible for the property.  For example, if there are no lights in the staircases or the lights are very dim.  Report if handrails are needed or there are cracks in the pavement.  For “ceiling falls,” there are usually some signs of the problem beforehand.  Report any discoloration or defects in your ceiling to your landlord or super immediately.  If they do not make repairs, follow up with a complaint in writing.  Of course, the goal is to have the problems fixed so that nobody does get hurt, but if do, it is also “notice” that the responsible parties were aware of the problem and failed to fix it.
